Industrial Design Registration: Why Product Appearance Matters

Trademarks

While patents protect how a product works and trademarks protect how it is identified, industrial designs protect how it looks. For consumer products, packaging, furniture, and fashion, appearance is frequently the primary competitive advantage.

What a design registration covers

A registered design protects the visual features of a product: shape, configuration, pattern, and ornamentation. It does not protect functionality — that belongs to patents — nor the brand name, which belongs to trademarks.

Speed is a genuine advantage

Many regional offices examine designs on formalities only, without substantive comparison to earlier designs. Registration can issue within months, giving enforceable rights quickly and at a fraction of patent cost.

Novelty and grace periods

Disclosure before filing can destroy novelty. Some jurisdictions offer limited grace periods, but relying on them is risky. The safest discipline is to file before launch, before trade shows, and before any public announcement.
